1. Scope

• This license governs the use of downloadable data and materials provided by busmaps.com, such as GTFS exports, JSON exports, images, and maps.
• This license does not cover access to or use of the busmaps.com API. API usage is governed by a separate agreement: the Terms and Conditions.

2. Definitions

• "Data": All derivative works and materials related to public transportation provided under this license by busmaps.com, including but not limited to:
  • Improved GTFS (General Transit Feed Specification) static public transit data
  • Images
  • JSON exports
  • Maps
  • Any other associated data and materials
• "You" and "Your": Any individual or entity using the Data.
• "Licensor": busmaps.com.
• "Commercial Purposes": Any use of the Data intended for or directed toward commercial advantage or monetary compensation, including use in paid products or services, advertising-supported products or services, or internal business operations.
• "Non-Commercial Purposes": Any use of the Data that does not qualify as Commercial Purposes.

3. Grant of License

busmaps.com grants You a perpetual, worldwide, royalty-free, non-exclusive license to use, copy, modify, merge, publish, and distribute the Data for any non-commercial purposes. This license does not include the right to sublicense the Data.

You must obtain a separate commercial license from busmaps.com to use the Data for any commercial purposes. For commercial licensing inquiries, please contact us.

4. Conditions

• 4.1.1. Required Attribution
  You must include the following attribution in any product, publication, or service that uses the Data:
  "This product includes derivative public transportation data provided by busmaps.com. For more information, visit busmaps.com"
• 4.1.2. Placement of Attribution
  • The attribution must be clearly visible and accessible to end-users.
  • If the Data is used in a graphical user interface (GUI), the attribution should appear within the GUI or in accompanying documentation.
  • If the Data is used in a publication, the attribution should appear in a footnote or in the references section.
• 4.1.3. Hyperlink
  Where possible, the website link should be a clickable hyperlink directing to https://busmaps.com.

5. Restrictions

• You may not use the Data for commercial purposes without obtaining a commercial license from busmaps.com.

• You may not sublicense the Data without prior written permission from busmaps.com.

• You must accurately assess whether Your use of the Data is commercial or non-commercial under this license.
• Upon request, You agree to provide documentation reasonably necessary to verify compliance with this license.

6. Disclaimer of Warranties

• The Data is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• busmaps.com does not warrant that the Data will be error-free or that any errors will be corrected.

7. Limitation of Liability

• In no event shall busmaps.com be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including but not limited to procurement of substitute goods or services; loss of use, data, or profits; or business interruption) arising in any way out of the use of the Data, even if advised of the possibility of such damage.

8. Termination

• 8.1. Automatic Termination
  This license and the rights granted hereunder will terminate automatically if You fail to comply with any term of this license.
• 8.2. Obligations Upon Termination
  Upon termination, You must cease all use of the Data and destroy all copies in Your possession or control.

9. Governing Law

• This license shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

10. Entire Agreement

• This license constitutes the entire agreement between the parties regarding the Data and supersedes all prior agreements, understandings, and communications, whether written or oral.

11. Severability

• If any provision of this license is held to be unenforceable, this license shall be construed as if such provision were not included, and the remaining provisions shall remain in full force and effect.

12. No Waiver

• The failure of busmaps.com to enforce any right or provision of this license will not be deemed a waiver of such right or provision.
